1. SERVESHWAR FOOD PRODUCTS PRIVATE LIMITED operating under it trade name: Lacy Foods (hereinafter referred to as “We/Our/Company/Serveshwar/ Lacy Foods”) is a Company incorporated under the Companies Act, 2013 having CIN U15135UP2002PTC027160 and having its registered Office at Dhakpura Road, Hathras, Uttar Pradesh, India, 204101. The Company is a food and snacks brand dealing in the business of namkeen and other types of snacks through offline and online mode from its website https://www.lacysnacks.com/ to serve its Customers (hereinafter referred to as “Customer, User, User’s, You, Your, Yours”) through its Website (hereinafter referred to as “Platform”).
2. The Company is deeply committed regarding the privacy of its Users, confidentiality and security of personal data/information or personally identifiable information (hereinafter referred to as “PII”) that resides with the Company. Keeping the User’s PII secure and preventing any misuse thereof, is therefore a top priority of the Company. The Company is strongly committed to protecting to privacy of the Users and has taken all necessary and reasonable measures to protect the confidentiality of any information including PII shared by the Users.
3. As used in this Policy, PII shall mean and include any information that alone or in combination with other information related to a specific identifiable individual person. By way of illustration and not limitation, PII includes individual’s name, mobile number and address.

The information you provide helps us to create customized content. You will receive the information only for the products and services that interest you.
   3. Additionally, for quality and training purposes or for its own protection, Company may monitor or record its telephone conversations with User or anyone acting on User’s behalf. By communicating with the Company, User acknowledges that User’s communication may be overheard, monitored, or recorded without further notice or warning.
   4. In order to help protect User from fraud and misuse of User’s personal information, the Company may collect information about User and User’s interactions with Company.

1. User’s PII may be used to set up and administer User’s account, provide necessary technical support, verify User’s identity and send important communication.
2. User’s PII may be used to deliver advertising, marketing and event based communication. Such communication may contain option to opt out of receiving such communications in future. If User choose to opt out of receiving such communication, User may email us at  lacysnacks@gmail.com post which the Company shall not contact User and will ensure that new data collected about User from then on will not be used by the Company for any such purpose.
3. The Company may use User’s PII for internal and external research and development purpose and to improve and test the features and functions of the Platform for giving the best buying experience to the User.

7. The Company may use and retain User’s PII for legal and compliance reasons, such as the prevention, detection, or investigation of a crime; loss prevention; fraud,  or to meet the Company’s internal and external audit requirements, information security purposes, and or which is required

   2. to respond to requests from courts, law enforcement agencies, regulatory agencies, and other public and government authorities,
   3. To enforce Company’s Terms and Conditions; and
   4. To protect the Company’s rights, privacy, safety or property, or those of other persons.
8. User however acknowledge and accept that in case of information that may be asked by any Court or government authority, the Company will intimate User of such information being given to the court or government authority only if the Court or government authority permits the Company to do so.
9. The Company does not sell information about its Users to any person or entity whatsoever. However, during development of its business, the Company may sell or buy companies or assets. In such transactions, User’s information may be transferred to such companies or assets.
10. Company also use User’s information for the following purposes:
    1. Generating and maintaining User’s profile on the Platform.
    2. Provide personalized marketed products.
    3. Internal usage to provide better services.
    4. Provide targeted customized advertisements to the Customers.
    5. Maintaining regular communications with User concerning transactions that User initiate, such as requesting information or assistance, making payments, using Platform etc.
    6. Modifying the Platform from time to time to cater to User’s interests.
    7. Providing the Platform and the functions therein efficiently.
    8. To conduct analytical studies on various aspects including User buying behavior and preferences etc.
    9. To determine any security breaches, computer containment or computer virus,
    10. To investigate, prevent or take action regarding illegal activities and suspected frauds,
    11. To undertake resources as a part of the investigation or internal audit,
    12. To enhance the ability of the Company to communicate with User and customers about additional Services;

To trace computer resources or any person who may have contravened or is suspected of having or being likely to contravene, any provision of law including the Digital Personal Data Protection Act, 2023 and  Information Technology Act, 2000 that is likely to have an adverse impact on the Platform
    14. To provide technical assistances requiring initial setup, support services or dealing with any suspicious activities from the user accounts.
11. The Company may use the User’s PII for marketing or social media platforms like Google, Twitter, Facebook, Instagram. We use these platforms to conduct targeted advertising.

1. User expressly consent to provide details/information/documents to the Company under this Privacy Policy.
2. User while providing User’s details/documents over the Platform, including but not limited to the personal information or other information as mentioned hereinabove, expressly consent to Company (including its affiliates and business partners) to contact User through SMS, call and/ or e-mail and to follow up calls in relation to the services provided through the Platform, for imparting knowledge, offering promotional offers running on Platform & various other offers offered by its business partners.

1. The consent provided to the Company by User for collection of PII and such other information on need to know basis may be withdrawn at anytime by emailing us at lacysnacks@gmail.com.
2. Once such consent User is withdrawn, the Company shall immediately stop using such information as maybe provided by User for which such revocation has been sought by User and further stop providing such data to third parties.
3. However, the Company may use certain information i.e. digital footprints internally.

1. The Company may share the information provided by User with the third parties, including service providers, affiliated entities and payment processing service provider for the following purposes:
   1. Information may be shared with the Company’s service providers and affiliates to assist in operation of the activities on the Platform.
   2. Information maybe shared with fraud prevention and detection service providers for the purpose of detecting and preventing fraudulent activity.
   3. Information maybe shared if the Company believes it necessary to disclose information to investigate, prevent or take action regarding illegal activities, suspend fraud, violations of Terms of Use and Privacy Policy.
2. The Company may also share User’s information for the following purposes:
   1. For customer service purposes, including to help service User’s accounts or resolve disputes (e.g., billing or transactional).
   2. In case of any information asked by Law enforcement, government officials, or other third parties pursuant to a subpoena/summon, court order, or other legal process or requirement applicable to the Company or any of its affiliates.

User explicitly give consent to the Company to share such information in cases as stated in Clauses 5.10.10, 5.10.13 and 8.2.

      These Cookies are used by the Company or third-party service providers to analyze how the Platform is used and its performance. The Company uses Cookies from Google Analytics to obtain web analytics data. Google Analytics collects information about User’s interaction with the Platform including information on the pages User visits and how long User remains on the Platform.

1. The Company will retain User’s information for as long as necessary for providing the services available on the Platform or till User’s request to terminate User’s Account, whichever is later.
2. The Company may be obligated to retain certain information under the applicable law and/or as part of its contractual obligations with the third parties and accordingly such information shall be retained as prescribed under the applicable law or part of Company’s contractual obligation.

Post termination of User’s account or withdrawal of consent to use certain information/ data, the Company continue to use User’s anonymized data aggregated or in combination with anonymized data of other users. The Company uses this aggregated anonymized data for data analysis, profiling and research purposes, for example to gain insights about the Users and their profiles. The Company may keep User’s contact information along with User’s application details (if any) for fraud prevention purposes and for the exercise/ defence of a legal claim or for providing evidence in legal proceeding(s).

In case User would like to modify / delete any details with respect to User’s Personal / Non-personal information, or to access User’s information in readable format, User can write to lacysnacks@gmail.com.

Upon becoming aware of an alleged violation of this Policy or Terms of Use, the Company may initiate an investigation. The Company retains the right to suspend, restrict or limit User and User’s account in order to prevent further unauthorized activities.

2. provides for the various types of personal or sensitive personal data of information to be collected;

5. User further acknowledges that the User has attained the age of majority as per applicable laws and is competent as to understand and agree the terms, conditions, obligation, affirmations, representations and warranties set forth in this Policy. In case of any misrepresentation made by the User, the Company shall not be responsible for such information provided by the User. The User shall fully indemnify the Company against any claims, penalties and damages made by any third party or public/private authority in this regard.

When the User uses the Platform, the Company makes good faith efforts to provide the User, as and when requested by the User, with access to his/her PII and User shall further ensure that any PII or sensitive personal data or information found to be inaccurate or deficient shall be corrected or amended as feasible, subject to any requirement for such PII or sensitive personal data or information to be retained by law or for legitimate business purposes. The Company asks individual Users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests, and the Company may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup data), or for which access is not otherwise required.

The Company may update and change its Privacy Policy from time to time to provide efficient services and to safeguard User’s information. The Company may provide such information of change or updation of Privacy Policy. However, User shall check the Privacy Policy for periodically for such changes. In case of continued use of the of Platform provided by the Company shall mean that the changes in Privacy Policy have been accepted by User. The Company may make reasonable efforts to notify the User about changes in Privacy Policy.

The Company shall take reasonable measures to ensure the data of Users remains secure on the Platform, some parts of the PII can be viewed and edited through Your account protected by a password. We strongly recommend that you do not disclose your password to any other person. Serveshwar Food Products Private Limited will never ask You for Your password over the phone call or email. If You open Your account with another system, You should not choose to save Your log-in information. Further, it shall Your responsibility to sign out properly of Your account and close Your browser window when You have finished your session.

In case of any dispute or difference that may arise between the parties in connection with or arising out of this Privacy Policy, the Parties shall resort to Arbitration as the preferred dispute resolution mode in accordance with Arbitration and Conciliation Act, 1996. Each party shall nominate 1 (one) arbitrator each and the nominated arbitrators shall further nominate a presiding arbitrator to govern the arbitration process. The seat and venue of arbitration shall be HATHRAS 204101 UTTAR PRADESH and the language to be used in the arbitration shall be English.
2. This Privacy Policy shall in all respects be governed by, construed and interpreted in accordance with the laws of India and the state laws of Uttar Pradesh. The Parties submit to the exclusive jurisdiction of the courts of Hathras, Uttar Pradesh.
